This limited warranty extends to the “original purchaser” only. The original purchaser is defined for the purposes of this warranty to mean the initial contractor/purchaser and the initial property owner of the building into which the window or door is installed. This warranty is not transferable or assignable.
This limited warranty shall apply to all windows and doors manufactured by Benjamin Wade, LLC d.b.a. Malta Windows & Doors purchased after January 1, 2008.
Residential Installation – Lifetime
Malta Windows & Doors warrants that all non-glass components of its windows and doors that are installed in residential structures shall be free from defects in material and workmanship for the life of the original purchaser. During the warranty period Malta Windows & Doors shall, at its option, repair or replace (without installation) the affected component of any defective window or door; repair or replace (without installation) the entire defective window or door; or refund the then-current list price of the window or door.
Insulating Glass
The installed and sealed insulating glass units are warranted against defects resulting in material obstruction of vision from film formation caused by dust or moisture in the air space of the sealed unit. If such defects occur, Malta will provide a replacement insulating glass unit at no charge for a period of twenty (20) years. Malta will not be responsible for the installation or refinishing of replacement parts.
Exclusions
This warranty does not cover product failure or damage due to:
• Improper installation
• Condensation
• Floods, fires, hurricanes, tornados, and other acts of God
• Excessive heat or moisture
• Structural settlement
• Improper maintenance
• Altered or reinstalled products, including the installation of security systems
• Improper application of finishes, paint, films, sealants, or caulking
• Minor glass imperfections that do not affect normal visibility or product performance, including curvature of glass due to atmosphere conditions
• Normal wear or discoloration of finishes, including the tarnishing of brass
• Corrosion of aluminum cladding finishings, or other components due to environmental conditions, such as air pollution, acid rain, and other corrosive substances
Limitation of Liability
Malta Windows & Doors is not responsible for any cost or expense associated with the removal or reinstallation of any windows or door repaired or replaced pursuant to this warranty.
Building codes vary between localities. Malta Windows & Doors makes no representation that its products meet local building code requirements.
THIS WARRANTY DOES NOT COVER ANY PRODUCT SHIPPED OUTSIDE THE UNITED STATES OF AMERICA.
ALL WARRANTIES IMPLIED BY STATE LAW, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY LIMITED TO THE DURATION OF THE LIMITED WARRANTIES SET FORTH ABOVE. Some states do not all limitations on how long an implied warranty lasts, so the above limitation may not apply to you. WITH THE EXCEPTING OF ANY WARRANTIES IMPLIED BY STATE LAW AS HEREBY LIMITED, THE FOREGOING EXPRESS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, GUARANTEES, AGREEMENTS AND SIMILAR OBLIGATIONS OF MALTA WINDOWS & DOORS WITH RESPECT TO THE REPAIR OR REPLACEMENT OF ANY PRODUCT OR PARTS. IN NO EVENT SHALL MALTA WINDOWS & DOORS BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. Some states do not allow the exclusion or limitation of incidental or consequential damages so the above limitation may not apply to you.
No person, agent, distributor, dealer, or company is authorized to change, modify, or extend the terms of these warranties in any manner whatsoever.
All disputes regarding the interpretation of this warranty including matters of construction, validity, and performance, shall be governed by Ohio law.
